1. Agreement to Terms

Welcome to West of West. These Terms of Service ("Terms") govern your access to and use of the website located at westofwestvintage.com (the "Site") and any purchase you make from West of West LLC ("West of West," "we," "us," or "our"). By accessing the Site, browsing our listings, or placing an order, you agree to be bound by these Terms and by our Return Policy and Shipping Policy, which are incorporated here by reference. If you do not agree, please do not use the Site or place an order.

2. About Us

West of West LLC is a limited liability company organized under the laws of the State of California. We are a curated dealer of vintage and secondhand goods — vintage clothing, militaria, workwear, and related Americana — sold through this Site and through other marketplaces.

3. Eligibility

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to place an order. By placing an order you represent that you meet this requirement and that the information you provide is accurate and complete.

4. Our Products — Vintage and Secondhand Goods

Please read this section carefully, as it reflects the nature of what we sell.

  • Vintage and used. Nearly all items we offer are vintage, secondhand, or previously owned. They are decades old and were made and used before they came to us.
  • One of a kind. Most items are unique, single-quantity pieces. Once an item sells, it is generally gone and cannot be reordered.
  • Condition and wear. Signs of age — fading, patina, repairs, alterations, small holes, staining, and other imperfections — are expected and are part of the character of a vintage piece. We do our best to document condition honestly through photographs and written descriptions, and we disclose notable flaws where we are aware of them.
  • Descriptions and measurements. Measurements are approximate and are generally taken with the garment laid flat. Colors may appear differently depending on your screen. We describe items to the best of our knowledge and expertise, but we do not guarantee that a description is exhaustive.
  • Sold as-is. Because our goods are vintage and secondhand, they are sold on an "as-is" basis, subject to the descriptions provided and to the limited warranty disclaimers in Section 12 below.
  • Brand names and trademarks. We are an independent reseller and are not affiliated with, endorsed by, or sponsored by any brand, manufacturer, or military or government body whose products or insignia may appear in our listings. Any third-party names, marks, or logos are used solely to identify and describe the item being sold.

5. Pricing and Availability

  • All prices are listed in U.S. dollars (USD) unless otherwise stated.
  • Because our items are typically one of a kind, availability is not guaranteed until your order is confirmed and accepted.
  • We make every effort to display accurate pricing, but errors may occur. We reserve the right to correct any errors and to change prices at any time before your order is accepted.
  • We reserve the right to refuse, limit, or cancel any order at our discretion, including in cases of suspected error, fraud, or listing mistakes. If we cancel an order after you have been charged, we will issue a full refund of the amount paid for the cancelled item.

6. Orders and Payment

  • Placing an order constitutes an offer to purchase. Your order is accepted when we confirm and dispatch the item, at which point a binding contract is formed.
  • Payment is processed through our third-party payment providers via our Shopify storefront. By submitting payment information, you represent that you are authorized to use the payment method provided.
  • We do not store your full payment card details; payment processing is handled by our payment providers subject to their own terms and privacy practices.

7. Shipping

  • Shipping terms, timelines, and costs are described in our Shipping Policy.
  • Unless otherwise required by law, risk of loss and title for items pass to you upon our delivery of the item to the carrier.
  • International orders. You are the importer of record and are responsible for any customs duties, import taxes, tariffs, or other fees imposed by the destination country. These are not included in the item price or shipping charge and are your responsibility.

8. Returns and Refunds

Returns and refunds are governed by our Return Policy. In summary, and subject to the full terms of that policy: eligible returns are accepted within the stated return window, with store credit as the default remedy. Because of the one-of-a-kind, vintage nature of our goods, we ask that you review each listing's description, photographs, and measurements carefully before purchasing. Nothing in these Terms or in our Return Policy limits any non-waivable rights you may have under applicable consumer protection law.

9. Intellectual Property

All content on the Site — including photographs, written descriptions, catalog copy, graphics, page layout, and the "West of West" name and logo — is owned by West of West LLC or used with permission, and is protected by intellectual property laws. You may not copy, reproduce, republish, scrape, or redistribute any content from the Site for commercial purposes without our prior written consent. Our product photography and written descriptions are original work and may not be reused in other listings or marketplaces.

10. Acceptable Use

You agree not to use the Site to:

  • Violate any applicable law or regulation;
  • Interfere with or disrupt the Site or its servers;
  • Attempt to gain unauthorized access to any part of the Site or its systems;
  • Use automated means (bots, scrapers, crawlers) to access, copy, or monitor the Site or its content without our permission; or
  • Submit false or fraudulent order or payment information.

11. Third-Party Links

The Site may contain links to third-party websites or services that we do not control. We provide these links for convenience only and are not responsible for the content, policies, or practices of any third-party site.

12. Disclaimer of Warranties

To the fullest extent permitted by applicable law, the Site and all items are provided on an "as-is" and "as-available" basis. Because our items are vintage and secondhand, we expressly disclaim any implied warranties of merchantability and fitness for a particular purpose, except as they cannot lawfully be excluded. We do not warrant that the Site will be uninterrupted or error-free.

Nothing in this section excludes or limits any warranty or right that cannot be excluded or limited under applicable law, including any non-waivable rights you may have as a consumer under California law.

13. Limitation of Liability

To the fullest extent permitted by applicable law, West of West LLC and its members, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Site or any item purchased. Our total aggregate liability for any claim arising out of or relating to an order will not exceed the amount you actually paid for the item(s) giving rise to the claim.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

14. Indemnification

You agree to indemnify and hold harmless West of West LLC and its members, employees, and agents from any claims, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your breach of these Terms or your misuse of the Site.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. You agree that any dispute arising out of or relating to these Terms or your use of the Site will be subject to the exclusive jurisdiction of the state and federal courts located in the City and County of San Francisco, California, except where prohibited by applicable law.

16. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent version. Changes are effective when posted to the Site. Your continued use of the Site or placement of an order after changes are posted constitutes acceptance of the revised Terms.
